These Terms of Service (“Terms”) govern your access to and use of the Trishula Clothing website, online store, products, services, and marketing programs (collectively, the “Services”). Throughout these Terms, “Trishula Clothing,” “Trishula,” “we,” “us,” and “our” refer to Trishula Clothing.
By accessing or using our Services, placing an order, creating an account, or participating in one of our marketing programs, you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility and Use of the Services

Nothing in this section limits any rights you may have under mandatory consumer-protection laws.
3. Orders and Acceptance
Submitting an order does not necessarily constitute our acceptance of that order. We reserve the right, where permitted by law, to reject, limit, or cancel an order for legitimate reasons, including suspected fraud, payment problems, product unavailability, incorrect pricing, or violations of these Terms.
If we cancel an order after payment has been collected, we will issue an appropriate refund.
You are responsible for reviewing your order information, including products, sizing, quantities, shipping address, and contact information, before completing checkout.
4. Prices, Payment, Taxes, and Duties
Prices are displayed in the currency selected or otherwise shown on the website. Applicable taxes, shipping charges, duties, and other charges may be calculated or disclosed at checkout where supported.
For international orders, customs duties, import taxes, brokerage charges, or similar government-imposed fees may apply depending on the destination. Responsibility for these amounts will be determined according to the information provided at checkout, our Shipping Policy, and applicable law.
Payment must be made using an accepted payment method. Your payment information may be processed by Shopify and other authorized payment providers.
5. Shipping and Delivery
Shipping destinations, processing estimates, delivery estimates, customs information, and related conditions are described in our Shipping Policy, which is incorporated into these Terms by reference.
Delivery dates are estimates unless expressly stated otherwise. Delays may occur due to carriers, customs authorities, weather, supply-chain issues, or other circumstances beyond our reasonable control.
Nothing in these Terms limits statutory delivery rights available to consumers under applicable law.
6. Returns, Refunds, Cancellations, and Consumer Rights
Returns, refunds, exchanges, and cancellations are governed by our Refund Policy, except where applicable law provides you with additional or non-waivable rights.
If you are a consumer in the European Union, United Kingdom, or another jurisdiction that provides statutory cancellation, withdrawal, refund, repair, replacement, or warranty rights, those mandatory rights apply regardless of anything in these Terms or another Trishula policy that might state otherwise.
Where applicable law grants a consumer a right to withdraw from an online purchase, Trishula Clothing will honor that right in accordance with the applicable statutory requirements and exceptions.
7. Intellectual Property
The Services and their content—including Trishula Clothing names, logos, graphics, artwork, designs, photographs, product designs, text, website content, and other materials—are owned by or licensed to Trishula Clothing and are protected by applicable intellectual-property laws.
Except as permitted by law, you may not copy, reproduce, distribute, modify, publish, sell, exploit, or create derivative works from our content without our prior written permission.
Nothing in these Terms grants you ownership of any Trishula Clothing intellectual property.
8. Prohibited Uses
You may not use the Services for unlawful, fraudulent, abusive, deceptive, or harmful activity; interfere with the operation or security of the Services; attempt unauthorized access to systems or accounts; distribute malware or malicious code; infringe intellectual-property or privacy rights; scrape or harvest data in violation of applicable law; or use the Services in any manner that violates these Terms or applicable law.
We may suspend or restrict access to the Services for violations of these Terms where permitted by law.
9. Third-Party Services and Links
Our Services may rely on or link to third-party services, including Shopify, payment providers, shipping carriers, social-media platforms, analytics providers, and other service providers.
Third-party services may be governed by their own terms and privacy practices. Except where applicable law provides otherwise, Trishula Clothing is not responsible for third-party services that we do not control.
10. Email Marketing
If you separately opt in to receive marketing emails from Trishula Clothing, we may send you product announcements, drop information, restock notifications, offers, and other promotional communications.
You may unsubscribe from marketing emails at any time using the unsubscribe mechanism included in our emails. Unsubscribing from marketing does not prevent us from sending transactional or service-related communications when appropriate, such as order or account communications.
11. SMS Marketing Program
By opting in to the Trishula Clothing text messaging program, you agree to receive recurring automated marketing text messages from Trishula Clothing at the mobile number you provided, which may include information about product drops, restocks, promotions, offers, and other marketing communications.
Consent to receive marketing text messages is not a condition of purchasing any goods or services.
Message frequency varies. Message and data rates may apply.
You may opt out of marketing text messages at any time by replying STOP to a message or by using another unsubscribe mechanism provided in the message where available. Reply HELP for help.

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to wireless-carrier and network availability.

Where local telecommunications, privacy, or electronic-marketing law provides additional rights or requirements, those laws will apply.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge that personal information may be processed as described in that policy and as otherwise permitted by applicable law.
Marketing consent for one communication channel does not automatically constitute consent for another. For example, subscribing to email marketing does not by itself authorize SMS marketing, and vice versa.
13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, or error-free.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, fraudulent misrepresentation, intentional misconduct, or other liability protected by mandatory law.
Nothing in this section limits any non-waivable consumer right, statutory remedy, product guarantee, or other protection available under the laws applicable to you.
15. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses, claims, or expenses arising directly from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.
This section does not create liability for consumers where such liability would be prohibited or unfair under applicable consumer law.
16. Governing Law and International Consumers
Except where mandatory law provides otherwise, these Terms and disputes relating to them are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles.
If you are a consumer residing outside New York, this choice of law does not deprive you of mandatory consumer protections or rights that apply to you under the laws of your place of residence.
Nothing in these Terms requires a consumer to waive rights that cannot lawfully be waived.
17. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.

We may update these Terms from time to time to reflect changes in our Services, business practices, technology, or applicable law.
The current version will be posted on this page together with an updated “Last updated” date. Where applicable law requires additional notice or consent for a material change, we will provide it.
19. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and other policies expressly referenced in these Terms, constitute the agreement governing your use of the Services to the extent permitted by applicable law.
